COVID-19 Workman’s comp death case at Conference.
Facts: Front line healthcare worker, in her 50’s who worked for three different employers all concurrently contracted COVID-19 and died two months later. Client was married and survived by her husband. The three employers all pointed fingers at each other and indicated that she must have contracted covid in the community and not at work despite working in a facility with multiple positive covid patients. The insurance companies also challenged the cause of death stating it was natural causes and not work related. After a full Conference hearing with a DIA judge attorney Beauregard was able to get an order that two of the employers had to pay her lost wage benefits to her surviving spouse, pay for her medical expenses and funeral expenses.
